<p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Today let's talk about the alarming persistence of scams on Meta's platforms — and a novel legal strategy that may force the company to do more about them. (At the possible expense of tech's most important liability shield.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Last month we discussed <a href="https://www.platformer.news/r/c30feabe?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Meta's scam problem</a>, the staggering breadth of which was revealed by Jeff Horwitz in <a href="https://www.platformer.news/r/54876aca?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">an exposé for Reuters</a>. In it, he documented how the company projected that fully 10 percent of its 2024 revenue would come from ads for scams and banned goods, and that one-third of all successful scams in the United States now take place on its platforms. (The company disputed those numbers without offering any of its own.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">For the most part, the consequences are borne by Meta's user base. While regulators have investigated the prevalence of fraud on Meta platforms, the company anticipates only $1 billion in fines. But it expects scam ads to generate $3.5 billion every six months, incentivizing it to maintain the rough contours of its current system. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On Monday, in a new investigation for Reuters, Horwitz examined the relationship between Meta and its advertisers in China. While Meta is banned in the country, China allows domestic businesses to advertise to foreign customers. Last year Meta had more than $18 billion in ad sales from China, representing more than 10 percent of its revenue.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">"But Meta calculated that about 19% of that money – more than $3 billion – was coming from ads for scams, illegal gambling, pornography and other banned content, according to internal Meta documents reviewed by Reuters," Horwitz writes. <a href="https://www.platformer.news/r/d2d3ac17?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">He continues</a>:</p><blockquote style="margin: 0; padding: 0; border-left: #2047FF 2px solid; font-size: 17px; font-weight: 500; line-height: 1.6em; letter-spacing: -0.2px; color: #15212A;"><p style="line-height: 1.6em; margin: 2em 25px; font-size: 1em; padding: 0; color: #15212A;">The documents show that Meta believed China was the country of origin of roughly a quarter of all ads for scams and banned products on Meta’s platforms worldwide. Victims ranged from shoppers in Taiwan who purchased bogus health supplements to investors in the United States and Canada who were swindled out of their savings. “We need to make significant investment to reduce growing harm,” Meta staffers warned in an internal April 2024 presentation to leaders of its safety operations. [...]<br><br>In one February 2025 document, it noted the “adversarial” nature of the Chinese market, where some advertisers are focused on quick profits, not steady business or brand-building. Unspecified “cultural factors,” the document added, destigmatize unethical business practices targeting foreigners.<br><br>In the same February document, Meta managers said the company would tolerate elevated levels of misconduct by Chinese advertisers on a permanent basis. Rather than seek “parity” between the quality of Chinese ads and the rest of the world – a target it appeared close to achieving during its brief battle against fraudsters last year – it would preserve the status quo, merely aiming to “maintain the % of global harm” from China.</p></blockquote><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">As Horwitz documents, Meta has made its own job harder by allowing 11 Chinese ad agencies to serve as resellers and granting them "special protections" that require human intervention to remove ads that violate the company's rules. In many cases, by the time a human reviews the ad, the scam has already been completed. Meta also lets advertisers share accounts, making it even harder for the company to know who it's doing business with. If an advertiser does get caught and banned, Horwitz writes, buying a new account is trivially easy.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In a highlight of the investigation, Horwitz <a href="https://www.platformer.news/r/c1ef7bc6?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">bought a series of ads</a> for dubious (and nonexistent) money-making schemes through a second-tier ad agency, advertising his desire to run ads that violate Meta's rules. ("I wasn’t surprised to see agency accounts available on shady digital forums, where online marketers openly discuss ways to sell black-market products," he writes. "It was more of a shock to see them for sale in Meta’s own partner directory, a listing of companies that Meta said had been “vetted for their expertise.”)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Horwitz found an official Meta partner that offers a tutorial titled "How to Advertise Illegal Products on Facebook.” He found that when he told them he planned to violate Meta's rules, the agencies simply charged him a slightly higher commission. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In response to Horwitz's story, Meta deleted its partner directory and said it would conduct a review.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Meta didn't respond to my request for comment today. In a series of Threads posts, Meta spokesman Andy Stone <a href="https://www.platformer.news/r/add66e74?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">cast aspersions</a> on Horwitz's story, saying "Once again, Reuters is misconstruing and misrepresenting the facts."</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Still, no one is disputing that a reporter was able to contact multiple Meta partners that the company said had been "vetted for their expertise" and say "Hi, I'm here to do fraud, please help" and they responded by slightly increasing their prices and let him get right to work.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">And that dynamic seems unlikely to change on its own, for the reasons described above: it is simply more lucrative for Meta to permit these scams than it is for it to ramp up its enforcement efforts.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But a class-action case now winding its way through federal court threatens to upend that dynamic. And it could have serious implications for all platforms that host commerce.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In <em>Calise v. Meta Platforms</em>, a group of plaintiffs sued the company after they were defrauded by scam ads hosted by Meta. Christopher Calise tried to buy a car-engine assembly kit on Facebook for $48.97 that was never delivered; another plaintiff lost about $31 when a toy for her toddler arrived looking nothing like the product advertised.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><a href="https://www.platformer.news/r/acb1fb92?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">The complaint</a> notes that Meta courts Chinese advertisers aggressively despite the fact that the company's own estimates show that a substantial portion of Chinese ads are fraudulent.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The initial case was dismissed in 2022. In <a href="https://www.platformer.news/r/26f38a83?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">his ruling</a>, the judge cited Section 230 of the Communications Decency Act, which shields platforms from liability in most cases for what their users post. Section 230 applies to ads on Meta's platforms, the judge said: the government cannot treat it as the publisher of third-party ads or make it responsible for the fraud it enables.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But the plaintiffs appealed. In June 2024, the Ninth Circuit revived key claims and sent the case back. And in September, a district court judge <a href="https://www.platformer.news/r/19de75f8?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">ruled partially in their favor</a>. Here's <a href="https://www.platformer.news/r/a1e51c59?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Margaret Attridge in <em>Courthouse News</em></a>:</p><blockquote style="margin: 0; padding: 0; border-left: #2047FF 2px solid; font-size: 17px; font-weight: 500; line-height: 1.6em; letter-spacing: -0.2px; color: #15212A;"><p style="line-height: 1.6em; margin: 2em 25px; font-size: 1em; padding: 0; color: #15212A;">U.S. Senior District Judge Jeffrey S. White <a href="https://www.platformer.news/r/490a640b?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">denied</a> Meta’s motion to dismiss the breach of contract and breach of the covenant of good faith and fair dealing, finding that Meta’s Terms of Services and Community Standards created an obligation for Meta to take action against deceptive advertisers.<br><br>“In the COS, Meta promises to ‘remove content that purposefully deceives, willfully misrepresents or otherwise defrauds or exploits others for money or property,’” he said in his order. “These promises manifest its intent to be legally obligated to ‘take appropriate action’ to combat scam advertisements. The ambiguous introductory language does not negate these promises.”</p></blockquote><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">When you create a Facebook account, Meta tells you it will remove deceptive and fraudulent ads. In reality, Horwitz has reported, Meta shows its user base 15 billion scam ads per day. Given those facts, Judge White ruled, plaintiffs may be able to prove that Meta breached its contract with its users.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Eric Goldman, a law professor and staunch defender of Section 230 whose work I admire, has called the court's ruling "<a href="https://www.platformer.news/r/db7be66b?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">disastrous</a>." Goldman sees the case as an end-run around Section 230 protections that seeks to impose <a href="https://www.platformer.news/r/ef7bd789?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">a previously unknown "duty"</a> on platforms to detect and remove fraud.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">"One way of reading the plaintiffs’ claims is that they seek to hold Facebook liable for all Facebook Marketplace transactions gone wrong — an impossible standard," he writes. "Also, every self-service ad platform will always enable some scams and fraud, so this case could shift liability to Facebook for all of them. Given these stakes, Facebook HAS to win this case."</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On one hand, if this is the case that breaks Section 230, the fallout for free expression online really could be disastrous. If courts take this same logic and rule that Meta has a "duty" not to show content that might incite violence, for example, we would likely see significant restrictions on digital speech over liability concerns.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On the other hand, though, I find it hard not to feel sympathy for the plaintiffs here. Meta told them it would remove deceptive ads from its platform, then allowed 15 billion of them to be shown every day. It profited massively from those deceptions — including from the ones that affected the plaintiffs. And the actual scammers often live in other countries, including China, where they cannot be held accountable in a real sense. (Reuters went to visit some of the scam advertisers' listed offices and found that they do not even exist.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Meta will fight this case to the end, because it has too much to lose if the Ninth Circuit's logic holds. But the company's user base has reason to fight, too. Meta has made clear to them that their individual losses are of no real concern to it. The number of scams that it hosts each day shocks the conscience. In private, the <em>Washington Post</em> <a href="https://www.platformer.news/r/e252f07b?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>reported</u></a>, the White House got calls from governors, congressman, and conservative advocacy groups that had concerns with the order.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The criticism underscores a growing tension between Trump’s populist base and the tech insiders increasingly shaping Trump’s AI policy, including White House AI and crypto Czar <strong style="font-weight: 700;">David Sacks</strong>. But this time, Sacks managed to thread the needle: in the week leading up to the final order, he met extensively with concerned Republican lawmakers and governors and offered assurances that the order will permit new legislation on child safety. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">By the time the order was published, with some edits based on MAGA feedback, Republican criticism had quieted, and Trump ally <strong style="font-weight: 700;">Mike Davis</strong> was on Steve Bannon’s podcast calling the order a “win.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But state lawmakers behind the AI rules Trump is targeting remained in <a href="https://www.platformer.news/r/ce00225d?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>vocal</u></a> opposition. Many focused on the order’s questionable legality. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“It's absurd for Trump to think he can weaponize the DOJ and Commerce,” California state Sen. Scott Wiener-D said, in order to “undermine those state rights.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><strong style="font-weight: 700;">Why we’re following:</strong> In last week’s Following, we said a leaked draft of the order seemed legally questionable. The final draft of the order still seems legally questionable. The federal government still plans to sue states based on questionable arguments about the Constitution’s interstate commerce clause, and still plans to withhold broadband funding in a way not carved out by the original law.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">There are a few notable changes, though. The order mentions the need for a federal framework created by Congress, and a carve-out assuring the order won't apply to child safety legislation, data center regulation, or state procurement of AI services.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The order also no longer mentions California’s SB 53, a transparency law on catastrophic risks from advanced AI. It only name-checks a Colorado law that addresses algorithmic discrimination as its main ideological target. David Sacks has since <a href="https://www.platformer.news/r/de4bfdd8?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>said</u></a> the administration isn’t sure whether they’d go after that California law, which primarily concerns transparency requirements.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Political opposition seems to have softened the scope of the order, which is looking less and less like an actual preemption of state AI legislation.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><strong style="font-weight: 700;">What people are saying:</strong> <strong style="font-weight: 700;">Mike Masnick</strong>, editor of <strong style="font-weight: 700;">Techdirt</strong>, <a href="https://www.platformer.news/r/07bc7dd2?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>criticized</u></a> media coverage of the executive order in an article titled “Trump Pretends To Block State AI Laws; Media Pretends That’s Legal.” He pointed out that the executive doesn’t actually have the legal authority to preempt state AI laws, which is why Trump is using roundabout tactics. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">As a result, Masnick argued that outlets publishing headlines like “Trump signs executive order blocking states from regulating AI” are over-representing Trump’s power to regulate state AI laws.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“Executive orders aren’t laws. They’re memos. Fancy, official memos that tell federal employees how to do their jobs, but memos nonetheless,” Masnick said.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On the other hand, one of those fancy memos brought TikTok back from the dead earlier this year, despite the fact that Congress had passed a law banning it unless it were sold.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In an <a href="https://www.platformer.news/r/5498c7c3?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>interview</u></a> on <em>Bloomberg Tech</em>, David Sacks defended the order. If states pass a wide variety of AI laws, that’s “going to be very hard for small companies and startups, especially innovators, to comply with.
