See </em><a href="https://www.platformer.news/r/e546cac9?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><em><u>my full ethics disclosure here</u></em></a><em>.</em></p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In keeping with this week's theme of <a href="https://www.platformer.news/r/436ce26d?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">companies getting away with things</a>, let's talk about the record industry's decision to settle with AI companies that built models with their intellectual property. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Along with its rival Udio, Suno had built a generative AI music creation platform by apparently scraping vast amounts of copyrighted material and training its model on that work. Last year, the three major record labels and the Recording Industry Association of America sued both companies alleging mass infringement of their copyrights. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The lawsuit is one of a series of closely watched cases that will answer the question of how AI companies are allowed to use copyrighted material. If you create a song built on the work of thousands of uncompensated artists, do you owe them anything? Or will a court declare it to be a "transformative use," and transfer all of the value to whoever can build an LLM?</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Increasingly it seems like we will not get a definitive answer on that question, at least when it comes to music. Today, Warner Music Group announced that it had <a href="https://www.platformer.news/r/3bdfffe5?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">settled its copyright lawsuit against Suno</a>, the latest in a series of settlements that suggest the record industry came to believe it could not afford to gamble on a trial. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Here's Murray Stassen at <a href="https://www.platformer.news/r/931320de?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><em>Music Business Worldwide</em></a>:</p><blockquote style="margin: 0; padding: 0; border-left: #2047FF 2px solid; font-size: 17px; font-weight: 500; line-height: 1.6em; letter-spacing: -0.2px; color: #15212A;"><p style="line-height: 1.6em; margin: 2em 25px; font-size: 1em; padding: 0; color: #15212A;">Warner Music Group<strong style="font-weight: 700;"> </strong>and AI music generator Suno have struck what they call a “first-of-its-kind partnership”.<br><br>They claim the deal will “open new frontiers in music creation, interaction, and discovery, while both compensating and protecting artists, songwriters, and the wider creative community”.<br><br>The deal also settles previous litigation between the companies.</p></blockquote><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In fact, whatever partnership is being celebrated here does not appear to be the first of its kind. Last month, Universal Music Group <a href="https://www.platformer.news/r/02843417?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">settled its case with Udio</a>, and similarly promised to launch a new suite of creative tools based on the label's catalog. And last week, Bloomberg's Lucas Shaw reported that Warner, Universal and Sony Music <a href="https://www.platformer.news/r/a686cd6c?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">had all licensed their works to a new music startup named Klay</a>, which is "building a streaming service that will allow users to remake songs using artificial intelligence tools."</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Financial terms of these deals have not been disclosed. But labels are getting more than money in these settlements. Stassen reports that next year, Suno will deprecate its current, gray-market models in favor of licensed ones. Free users will no longer be able to download the tracks that they create. And it seems likely that those models will let artists opt out of having their works included. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"> “AI becomes pro-artist when it adheres to our principles: committing to licensed models, reflecting the value of music on and off platform, and providing artists and songwriters with an opt-in for the use of their name, image, likeness, voice and compositions in new AI songs,” Warner Music CEO Robert Kyncl said in a statement to Stassen.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In that sense, the settlement seems to have achieved a core objective of the original lawsuit: to prevent artists from having their music used in these systems against their will. But the larger question of whether it is legal to train models on copyrighted work still looms over the entire creative field.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Over the past year, creatives have received worrying signs that the courts may not be on their side. In May, the US Copyright Office <a href="https://www.platformer.news/r/fd25bafc?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">declined to say that training on copyrighted works is always illegal</a>, saying that it would depend on the specific circumstances and the potential harm to the market. And in another lawsuit, a case against Anthropic produced a mixed result: a judge found the company liable for acquiring millions of pirated copies of books, but said that training its LLMs on lawfully acquired books constituted “quintessentially transformative” fair use. (Anthropic settled that case for $1.5 billion.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">As the year went on then, record companies faced the growing risk that courts would rule against them. The nightmare scenario was something like the <a href="https://www.platformer.news/r/b5e4755f?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Google Books</a> case, which looked at whether scanning millions of books and making them searchable constituted fair use. After years of litigation, the the Second Circuit Court of Appeals found in favor of Google: scanning books without authors' permission and making them searchable was given the green light.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Should a similar scenario unfold in the record industry, it could mean that anyone could build a music-making tool out of any songs they could find online. And the record companies would be deprived of any revenue at all. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The move toward settlements and licensing agreements, distasteful as it no doubt seems to many artists, represents a safer path. And so long as artists can opt out of their work being included, the most obvious direct harm to individuals can be avoided.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Still, you can probably imagine what lesson the tech industry will take from this development. Just as Google learned with books, or YouTube did with Viacom, it rarely pays to ask for permission — and forgiveness often comes more cheaply than you would guess. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The game of chicken that Suno played with the record industry took long enough to unfold that it now generates $200 million a year in annualized revenue. Last week, the company raised $250 million at a valuation of $2.45 billion.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Perhaps Suno and its rivals will expand the market for music, just as Spotify did a generation ago. But it could just as easily set the stage for AI-generated tracks to gradually outcompete songs written by humans, to the detriment of the culture.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It still seems crazy to me that the price an AI company has to pay to ingest and repurpose an entire art form might quite literally be zero. But when record labels had the chance to put that question to the test, they blinked. Suno and Udio are getting what they wanted all along. What do you do next?”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Sutskever told Dwarkesh that “now that compute is big,” more ideas are needed, and “we are back to the age of research.” </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Superhuman AI is between “5 and 20” years away, he said.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Throughout the interview, Sutskever kept coming back to large language models' ability to make generalizations about what they have seen, at least compared to humans. “The thing which I think is the most fundamental is that these models somehow just generalize dramatically worse than people," he said.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Sutskever thought the issue “points to the existence of some machine learning principle that I have opinions on.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But Ilya couldn’t tell Dwarkesh what he’d seen: “unfortunately, circumstances make it hard to discuss in detail,” he said, hinting he might have hit on some promising secret research direction.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Dwarkesh ended by asking Sutsekever about his research taste.
