<p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Today, let’s talk about a legal battle over teens and social media that may spur the Supreme Court to answer a highly consequential question: are the engagement-maximizing ranking algorithms that power YouTube, Instagram, TikTok and other platforms protected by the First Amendment? </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">If courts decide that ranking algorithms are acts of speech akin to newspaper editors selecting where to place individual stories, US lawmakers might be heavily restricted in their ability to regulate platforms. But if judges reject that argument, it could open up a significant new avenue for states and members of Congress to reshape platform behavior. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On Thursday, Meta, Google and TikTok <a href="https://www.platformer.news/r/ba1e4da4?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>filed complaints challenging a California law</u></a> that prohibits minors from viewing personalized feeds without their parents’ consent. The Protecting Our Kids from Social Media Addiction Act was signed into law by Gov. Gavin Newsom last year; industry lobbying group NetChoice then <a href="https://www.platformer.news/r/a1663b07?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>sued the state</u></a> to prevent it from taking effect. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">NetChoice’s argument: that the predictive algorithms that choose which Shorts, Reels, and TikToks to show you are a form of protected speech. California excluded more transactional services like Etsy and Yelp from the law; targeting only social media companies for restrictions could be seen as an illegal, content-based restriction on those platforms’ speech.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">NetChoice has had significant success in recent years fighting state laws that seek to prevent minors from accessing social media, winning injunctions in Ohio, Arkansas, and Georgia. It has also successfully blocked the implementation of California's Age-Appropriate Design Code Act.  </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In the California case, though, NetChoice largely failed to persuade the court. In September, a federal appeals court <a href="https://www.platformer.news/r/261b93f4?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>ruled that the state can enforce</u></a> the majority of its law targeting personalized feeds. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The law’s attempt to make social apps hide like counts by default is likely unconstitutional, the court said. But a three-judge panel for the US Court of Appeals for the Ninth Circuit found that NetChoice had failed to prove its core claim: that predictive ranking algorithms are protected speech.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“Some personalized recommendation algorithms may be expressive, while others are not, and that inquiry is fact intensive,” said Judge Ryan D. Nelson, according to <a href="https://www.platformer.news/r/5cb600f7?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>Isaiah Poritz’s account in Bloomberg Law</u></a>.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Nelson, who had likened the social media companies to Big Tobacco during oral arguments, took a more measured tone in his opinion. In particular, he did not make a definitive judgment on the question of ranking algorithms being protected speech. That “is a novel question, and we are careful not to decide more than necessary,” Nelson wrote. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">With the complaints filed on Thursday, the big platforms have decided to push for a definitive answer to that question. And it is a question that the Supreme Court — for now — has left hanging.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Last year, the court ruled against NetChoice in <a href="https://www.platformer.news/r/34d0cf87?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">two other cases</a> — <em>Moody v. NetChoice</em> and <em>NetChoice v. Paxton</em> — that concerned a different question about free expression on platforms. The cases, which targeted laws passed by Florida and Texas respectively, sought to undo legislation that would have prevented platforms from doing various forms of content moderation. The Florida law, for example, would have prevented platforms from terminating the accounts of political candidates.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In a 9-0 decision where judges disagreed sharply about some of the underlying issues, the court voted to vacate lower court rulings for failing to conduct a proper First Amendment analysis of the cases. Writing for the majority, Justice Elena Kagan wrote that decisions about which third-party speech to host are "editorial judgments" and thus protected under the First Amendment. But she made clear that the court was <em>not</em> ruling on ranking algorithms.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Justice Amy Coney Barrett agreed in <a href="https://www.platformer.news/r/b891bda0?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">a concurrence</a>:</p><blockquote style="margin: 0; padding: 0; border-left: #2047FF 2px solid; font-size: 17px; font-weight: 500; line-height: 1.6em; letter-spacing: -0.2px; color: #15212A;"><p style="line-height: 1.6em; margin: 2em 25px; font-size: 1em; padding: 0; color: #15212A;">But what if a platform’s algorithm just presents automatically to each user whatever the algorithm thinks the user will like—<em>e</em>.<em>g</em>., content similar to posts with which the user previously engaged? ... The First Amendment implications of the Florida and Texas laws might be different for that kind of algorithm. ... In other words, technology may attenuate the connection between content-moderation <em>actions</em> (<em>e</em>.<em>g</em>., removing posts) and human beings’ constitutionally protected right to “<em>decide</em> <em>for [themselves]</em> the ideas and beliefs deserving of expression, consideration, and adherence.” So the way platforms use this sort of technology might have constitutional significance.</p></blockquote><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In my layperson's understanding of the law, calling algorithmic predictions about which posts a person might like or leave a comment on "speech" feels like a corruption of the term. Particularly because no person at any of these companies can tell you with any certainty why any individual post appeared in your feed. They can tell you what signals they took into account, and which of your past behaviors likely influenced what you're seeing. But they also constantly show people posts that they later express regret over — porn, scams, violence and so on — and profess ignorance when asked why their systems showed those posts to users.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It's a funny kind of speech — one that can be traced to no individual person, and is in a language that no one fully understands.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Platforms <em>should</em> have the right to moderate content as they see fit — by setting community guidelines, by deplatforming bad actors, and by prioritizing some forms of content over others. Those are in fact editorial judgments, and social platforms would be all but unusable without them.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But lawmakers and government officials have noticed that social media presents <a href="https://www.platformer.news/r/df5510e1?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">meaningful risk of harms to young people</a>. And while short-form video may not be addictive in the same way or to the same degree that tobacco is, platforms have been relentless (and successful) in adopting features that maximize the amount of time young people spend on them. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It seems reasonable that the state should be able to regulate those features. California lawmakers know that social feeds are more addictive because they are personalized through algorithmic predictions; turn those predictions off, then, and perhaps social media will become dull enough that young people might have an easier time managing their relationship with it. (Or perhaps the platforms' direct messaging features and notifications will largely blunt the impact of more monolithic feeds.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Other states (and countries) have simply tried to ban social media altogether for younger teenagers, or to require them to get parental consent before creating accounts. Viewed in that light, California's law is actually one of the <em>less</em> restrictive efforts we've seen to regulate social media.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But lawsuits filed last week show just how afraid the platforms are of the idea that ranking algorithms might be subject to regulation. For more than a decade, social feeds have represented an enormously profitable means to capture the attention of billions of people. Take away their First Amendment protection, though, and that equation could change substantially.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Perhaps the platforms will succeed where their trade group did not. But public opinion has already turned on them. But <strong style="font-weight: 700;">Kumma</strong>, a teddy bear from Chinese company <strong style="font-weight: 700;">FoloToy</strong> that is powered by <strong style="font-weight: 700;">GPT-4o</strong>, engaged in explicit sexual roleplay, and offered users advice on where to find knives, pills, matches and plastic bags. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Like other tech and social media, the toys also have addictive design features aimed at keeping kids engaged, and do not have usage limit features. Often they are coming away unsettled.
