The move came six full weeks after the product launched in the United States — an increasingly common state of affairs for AI products in the European Union.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Threads, Meta's text-based social network, launched in the United States in July 2023. Its arrival in the EU was delayed <a href="https://www.platformer.news/r/0906f246?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">until December of that year</a> over privacy concerns.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Google Bard, the app that would become Gemini, launched in the United States in March 2023. A plan to launch in the EU in June was halted; it eventually shipped <a href="https://www.platformer.news/r/dc917d46?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">a month later</a>.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Apple Intelligence, which offers rudimentary text transformations, image generation, and other features, launched in the United States in October 2024; it came to Europe <a href="https://www.platformer.news/r/90060ba7?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">five months later</a>. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">OpenAI launched the original version of its Sora video generation model <a href="https://www.platformer.news/r/58a33ff7?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">last December</a>; it came to the EU in February.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On the surface, none of this seems like much to get worked up over. It's not uncommon for US tech companies to wait several months before rolling out their products outside the country. And none of the products listed above are exactly mission-critical in people's lives. If I lived in a country where the launch of Vibes had been delayed for several months, the primary emotion I would feel in the interim would be gratitude.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">All of which makes it more notable that within the EU, the reliable delay of the introduction of new AI products has become cause for alarm. And after a decade of steadily ratcheting up regulatory pressure on US platforms for issues related to data privacy, safety, and competition, the bloc now appears ready to reverse course.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The European Commission, which oversees tech regulation for the 27-country bloc, is planning to introduce a "digital omnibus" package of reforms later this month that would make it easier for AI companies to process certain categories of data for EU citizens. If passed, the omnibus could loosen parts of the General Data Protection Regulation — a law whose protections have been extended to Americans in many cases, and many big platforms choose to build one global privacy policy and roll it out to everyone. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Here's Ellen O'Regan <a href="https://www.platformer.news/r/1fa176df?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">at <em>Politico</em></a>:</p><blockquote style="margin: 0; padding: 0; border-left: #2047FF 2px solid; font-size: 17px; font-weight: 500; line-height: 1.6em; letter-spacing: -0.2px; color: #15212A;"><p style="line-height: 1.6em; margin: 2em 25px; font-size: 1em; padding: 0; color: #15212A;">Draft changes would create new exceptions for AI companies that would allow them to legally process special categories of data (like a person’s religious or political beliefs, ethnicity or health data) to train and operate their tech. The Commission is also planning to reframe the definition of such special category data, which are afforded extra protections under the privacy rules.  <br><br>Officials also want to redefine what constitutes as personal data, saying that pseudonymized data (where personal details have been obscured so a person can’t be identified) might not always be subject to the GDPR’s protections, a change that reflects a <a href="https://www.platformer.news/r/4d6cb088?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer noopener" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">recent ruling</a> from the EU’s top court.<br><br>Finally, it wants to reform Europe's pesky cookie banner rules by inserting a provision into the GDPR that would give website and app owners more legal grounds to justify tracking users beyond simply obtaining their consent.</p></blockquote><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The Commission plans to reveal its final proposal Nov. 19.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The potential weakening of EU tech regulations comes after <a href="https://www.platformer.news/r/15743105?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">intense criticism</a> from the Trump Administration, which has adopted the industry's complaint that all these rules and fines are simply tariffs by another name. But Trump has allies among European CEOs: this summer, the heads of Airbus and BNP Paribas were among those calling upon EU President Ursula von der Leyen <a href="https://www.platformer.news/r/4b5d23a7?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">to pause enforcement of its AI Act</a> for fears that it will make Europe less competitive.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In keeping with the near-incomprehensible nature of EU regulations, the AI Act "entered into force" in 2024 but much of it will not be operational <a href="https://www.platformer.news/r/4468117e?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">until 2027</a>. The act, which is meant to be the world's first comprehensive AI law, bans social scoring and other applications of AI while imposing other requirements related to compliance, transparency, and human oversight for others. But many platform executives complain that the bloc's rules still leave too much doubt about what is and is not OK when it comes to AI.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On one level, I'm sympathetic to any company that is afraid to launch a new feature in the EU. The bloc's <a href="https://www.platformer.news/r/341c888b?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">ongoing effort</a> to force Meta to adopt a model other than personalized ads or subscriptions, which arose after the passage of GDPR, feels like a particularly egregious case of overreach — and the sort of thing that makes companies say the hell with launching anything over there in a timely fashion.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On another level, though, I suspect the AI Act's provisions may prove to be popular with most EU citizens. <a href="https://www.platformer.news/r/e87a0eac?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Half of Americans</a> are already more concerned than excited about AI; the numbers aren't much better in many European countries, according to Pew research last month. Pew also found that 53 percent of EU residents had some or a lot of trust in the bloc to regulate AI.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It would be one thing if onerous AI regulations were preventing EU citizens from getting lifesaving medical care or high-performing AI coworkers. For the moment, though, Europe is getting just about everything Americans are — a few weeks to a few months later. (And for everything else, there are VPNs.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">CEOs still have <a href="https://www.platformer.news/r/0bff0f3f?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">legitimate questions</a> about what legal liabilities they might soon face for deploying AI systems in the workplace. And it's possible that by this time next year, red tape really will be getting in the way of Europeans accessing cutting-edge models in a timely fashion.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">For the moment, though, the EU's regulations are mostly annoying the right people. Four wrongful death suits were filed against the company last week, as well as three suits alleging that ChatGPT caused people to have mental breakdowns.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">A complaint filed by the father of a teenage boy who died in August says the boy talked to ChatGPT about suicide for a month before his death. Another, now dead, ChatGPT user asked “what it would take for its reviewers to report his suicide plan to police,” according to a complaint filed by his mother.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">One of the plaintiffs is <strong style="font-weight: 700;">Allan Brooks</strong>, whose ChatGPT-induced psychotic break the <em>New York Times</em> <a href="https://www.platformer.news/r/90750a8c?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>wrote about</u></a> in August. “Their product caused me harm, and others harm, and continues to do so,” he told the <em>Times</em>. “I’m emotionally traumatized.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><strong style="font-weight: 700;">Why we’re following: </strong>OpenAI's own analysis of ChatGPT conversations <a href="https://www.platformer.news/r/3569495f?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>estimated</u></a> that 0.07 percent of their users show signs of psychosis or mania per week — which corresponds to half a million users who might be experiencing psychosis or mania. More detailed reports of mental health issues involving individual ChatGPT users keep coming out at a steady clip.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">OpenAI has added safeguards like <a href="https://www.platformer.news/r/09607764?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>parental controls</u></a> in response to prior complaints and lawsuits about chatbot-related mental health crises and suicides.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The most recent wave of lawsuits cover incidents that happened before OpenAI’s policy changes. Still, evidence that the chatbot is putting vulnerable people at risk continues to surface. ChatGPT told him to cover his entire room in foil to “protect from the electromagnetic waves,” drink milk, and eat baby food, among other weird rituals.  </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“In a world that is increasingly designed for [vulnerable people] to be alone, they turned to this tech during a difficult moment in their life and just needed somebody to listen to them, only to have their chatbot destroy their reality,” Burback said. “I don't know if I trust that the guy who just opened Pandora's box also invented a lock that'll totally put it all back in. These people are not looking out for us. They are not our friends.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“<strong style="font-weight: 700;">Panera</strong>’s moderately caffeinated lemonade was loosely associated with 2 deaths before it was taken off market.
