One of the first clips to gain wide attention on the platform upon its release was one from an OpenAI employee depicting CEO Sam Altman <a href="https://www.platformer.news/r/3faed2f3?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>stealing GPUs from a Target</u></a>. Altman made his “cameo” available to everyone on the platform, tacitly permitting the user base to use his likeness in whichever ways the content guidelines would allow. And in some areas, those guidelines can be quite restrictive: sex and most politics, for example, are forbidden, as are various intellectual properties.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But OpenAI’s treatment of copyrighted material followed the same ready-fire-aim approach that its stance on historical figures did. At launch, Sora <a href="https://www.platformer.news/r/58047d68?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>readily produced videos</u></a> featuring characters from <em>SpongeBob SquarePants</em>, <em>Rick and Morty</em>, <em>Star Wars</em>, and <em>Pokémon</em>. Two days later, Altman <a href="https://www.platformer.news/r/218e9452?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>belatedly announced</u></a> “more granular controls” for generations of copyrighted material, and said the company would develop a revenue-sharing model. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In the <em>Hollywood Reporter</em>, Winston Cho reported on the chaos this all caused inside Hollywood talent agencies, with some agents accusing OpenAI of misleading Hollywood about the strength of the guardrails in its new video generation model. Among other things, studios and agencies say they are confused about how to opt their properties and client out of Sora. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><a href="https://www.platformer.news/r/a3d4b9f1?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>Cho writes</u></a>:  </p><blockquote style="margin: 0; padding: 0; border-left: #2047FF 2px solid; font-size: 17px; font-weight: 500; line-height: 1.6em; letter-spacing: -0.2px; color: #15212A;"><p style="line-height: 1.6em; margin: 2em 25px; font-size: 1em; padding: 0; color: #15212A;">Internally at studios and agencies, there’s confusion — and frustration — around the opt-out mechanism, according to people familiar with the matter, all of whom noted there’s no formal system for doing so and characterized Altman’s walk back as lip service. At the same time, its moral calculus has seemed arbitrary. In its X post about King, the company noted that “Some users generated disrespectful depictions of Dr. King’s image.” It seems likely that <em>most</em> historical figures being generated on the platform are being depicted in disrespectful ways. Why did the King case get OpenAI’s attention? Why did the Kings appear to have reached some formal agreement with the company, rather than simply be directed to whatever website OpenAI is sending the Hollywood studios?</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">OpenAI did not respond to a request for comment. But the company’s copyright walkback continued on Monday, this time in part due to complaints from <em>Breaking Bad</em> actor Bryan Cranston, saying <a href="https://www.platformer.news/r/190b7178?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>it will “collaborate” with the major US talent agencies</u></a> to stop “unapproved” generations. In a darkly comic twist, OpenAI also voiced support for the <a href="https://www.platformer.news/r/dd0fbd1a?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>NO FAKES Act</u></a>, which would make companies liable for generating AI audio and video of people without their consent — a foundational pillar of the Sora experience.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“OpenAI is deeply committed to protecting performers from the misappropriation of their voice and likeness,” Altman told CNBC, in a statement that left me staring blankly out my office window for a few minutes.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">"These examples make it blatantly obvious what has always been true, which is that the key driver of platform content policy has always been PR and reputation management," Evelyn Douek, an assistant professor of law at Stanford Law School and an expert in online speech regulation, told me when I called her today. "As much as platforms talk in the language of free speech — 'human rights' were even words that got thrown around at some point — the big driver has always been, what is going to be commercially and reputationally beneficial to them?"</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">In some ways, OpenAI’s ask-forgiveness-not-permission approach to copyright simply follows the same playbook that <a href="https://www.platformer.news/r/25ff5acd?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>YouTube did in its early days</u></a>, when it allowed users to upload large chunks of movies and TV shows whether they had permission or not. Google saw the move as a calculated risk that helped it acquire market share at a critical time; ultimately it settled the case and was able to normalize relations with Hollywood. OpenAI appears to view Sora in a similar way; its head of media partnerships <a href="https://www.platformer.news/r/6ad092cf?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>defended the lack of guardrails in the app</u></a> by saying “We don’t want it to be at a competitive disadvantage.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">At the same time, though, the Sora controversy appears to be another manifestation of a story that we’ve been tracking for more than two years now: the <a href="https://www.platformer.news/r/7d42c351?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>decline of trust and safety as a priority inside tech companies</u></a>, and the <a href="https://www.platformer.news/r/15a5bec0?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>devaluing of content policies focused on protecting individuals</u></a>. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">"It really does feel like we’re back in a move-fast-and-break-things era again," Douek said.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">OpenAI’s use of free expression as the rationale for enabling deepfakes of historical figures echoes Meta’s justification earlier this year for <a href="https://www.platformer.news/r/c68b0815?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>creating new permitted categories of hate speech</u></a> on its properties earlier this year. It also echoes YouTube’s stated reason for welcoming creators banned for election disinformation and COVID-19 hoaxes back onto the platform last month. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“No matter the political atmosphere, YouTube will continue to enable free expression on its platform, particularly as it relates to issues subject to political debate,” YouTube <a href="https://www.platformer.news/r/507689fd?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>told the House Judiciary Committee</u></a>.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Indeed, given the recent Republican enthusiasm for deepfakes (see Following below), one can imagine lawyers inside OpenAI warning executives that they might get hauled before Congress for <em>not</em> letting users generate video of historical figures.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Nonetheless, the past few weeks have cast fresh doubts on a company whose stated mission is to create AI that is beneficial to all of humanity. It is not at all obvious how generating videos of living actors without their permission is broadly beneficial, either to the actors or the broader public. (<em>Business Insider</em>’s Katie Notopoulos used Sora to create a convincing deepfake of Grateful Dead guitarist Jerry Garcia hawking a fake crypto coin, a capability that scammers will undoubtedly find quite compelling.) And the company’s admission that it chose not to implement more safety guardrails for competitive reasons has truly worrisome implications for a world where the underlying technology only grows more powerful — and the pressure to beat the competition increases accordingly.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">As AI tools continue to gain new capabilities, developers have a responsibility to mitigate the most obvious misuses of the technology <em>before</em> releasing it to the general public. OpenAI’s “let’s just see what happens” approach served the company tremendously well with the first version of ChatGPT, and it’s clear that the success of that product continues to inform the company’s strategy around releases. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It’s just as clear that this approach has long stopped serving the company well. From the Scarlett Johansson <a href="https://www.platformer.news/r/24b2ff54?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">voice mode controversy</a> to <a href="https://www.platformer.news/r/d9694875?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">GPT-4o sycophancy</a> to the more recent <a href="https://www.platformer.news/r/ae44fa42?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">backlash against GPT-5</a>, OpenAI’s rushed release schedule now routinely puts the company on the defensive. But with Altman now openly <a href="https://www.platformer.news/r/cf652088?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>acknowledging the connection</u></a> between revenue pressures and product releases, there is every reason to believe that policy concerns will continue to be eclipsed by the urgency of shipping. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">There was a time when OpenAI seemed determined to learn the lessons of the social media backlash, seeking out meetings with policymakers to discuss the risks of the technology it is building and applying strict guardrails to its products upon release. But now, with Sora, OpenAI is itself a social media company. The video was posted on the same day as the nationwide “No Kings” protests, which had large crowds gathered to protest authoritarianism. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Despite the video, and another AI-generated image showing him and vice president <strong style="font-weight: 700;">JD Vance</strong> wearing crowns once again, he told reporters that the protests mischaracterized him and he's “not a king.” </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Meanwhile, the <strong style="font-weight: 700;">National Republican Senate Committee</strong> <a href="https://www.platformer.news/r/eb220413?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>ran a 30-second ad</u></a> that featured Democratic senator <strong style="font-weight: 700;">Chuck Schumer</strong> saying “every day gets better for us,” suggesting the government shutdown becomes increasingly advantageous for Democrats the longer it drags on. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">While Schumer did say those words, he did <em>not</em> say them on camera — the ad used a a quote Schumer gave in a print interview with <em>Punchbowl News</em> and turned it into a synthetic video. The episode caused a big stir from AI researchers on <strong style="font-weight: 700;">X</strong>.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The economic case for AI job automation, Karpathy said, is “difficult.” He thinks that “The problem is, society will refactor based on the tasks that make up jobs, based on what’s automatable or not.” Karpathy gave the example of radiologists: their diagnostic abilities are mostly outperformed by AIs, but their wages continue to increase.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Karpathy is also skeptical of the current state of agents. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“Overall, the models are not there.
