After he wrote about it a few times, the phenomenon was named after him. A <a href="https://www.platformer.news/r/d8dd4a45?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Kinsley gaffe</a> is now defined as "a truthful statement told accidentally, usually by a politician."</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">I thought of Kinsley's coinage today when reading about a surprising observation made by Google's lawyers in <a href="https://www.platformer.news/r/983bc3a2?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">a legal filing</a> Friday in the ongoing antitrust lawsuit against the company related to its dominance in digital advertising. But in a court document filed by Google on Friday, Google's lawyers wrote, "The fact is that today, the open web is already in rapid decline."<br><br>This document can be found <a href="https://www.platformer.news/r/b6a3ec85?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">over here (PDF)</a> and on the top of page five, it says:</p></blockquote><blockquote style="margin: 0; padding: 0; border-left: #2047FF 2px solid; font-size: 17px; font-weight: 500; line-height: 1.6em; letter-spacing: -0.2px; color: #15212A;"><p style="line-height: 1.6em; margin: 2em 25px; font-size: 1em; padding: 0; color: #15212A;">"The fact is that today, the open web is already in rapid decline and Plaintiffs’ divestiture proposal would only accelerate that decline, harming publishers who currently rely on open-web display advertising revenue."</p></blockquote><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Schwartz's framing suggests why this filing made waves. On one hand, <a href="https://www.platformer.news/r/02e68c84?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">chatbots and AI search tools made by Google and its competitors</a> have increasingly enabled consumers to get what they need from the web without ever visiting any web pages. And on the other, Google has largely dismissed questions about this shift — responding with blithe optimism, <a href="https://www.platformer.news/r/75886536?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">carefully worded blog posts</a>, and almost no data.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">And so to see in a legal filing that the company's lawyers believe that the web is not just in decline, but in <em>rapid</em> decline — well, it had all the hallmarks of a Kinsley gaffe.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Google's communications apparatus quickly fanned out to walk back the statement and assert that it had been made in error. The company told me its lawyers did not mean to suggest that the entire web is in decline — only the part of the web that is supported by display advertising. Google plans to update the filing to clarify this, it told me late Monday.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“This is one cherry-picked line that misrepresents our legal filing," the company told me in a statement. "It’s clear from the preceding sentence that we’re referring to ‘open-web display advertising' and not the open web as a whole. We are pointing out the obvious: that investments in non-open web display advertising like connected TV and retail media are growing at the expense of those in open web display advertising.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">For what it's worth, it was not at all clear to <em>me</em> from the previous sentence that the lawyers weren't referring to the open web at large. (The previous sentence in question: "AI is reshaping ad tech at every level; non-open web display ad formats like Connected TV and retail media are exploding in popularity; and Google’s competitors are directing their investments to these new growth areas.") In fact, the argument follows logically from that sentence: display ad revenue is draining out of the open web, and the open web is rapidly declining as a result. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">At the same time, it's true that the filing does not make any further statements about the state of the web; it otherwise concerns itself exclusively with the ad market. I do believe it is possible, and perhaps even likely, that Google's lawyers told the truth here only by accident.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">By coincidence, the filing arrived just days after Google <a href="https://www.platformer.news/r/9050d25d?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">largely prevailed</a> in the <em>other</em> major US antitrust case against it — this one related to its illegal search monopoly. Judge Amit Mehta ruled that the company does not have to spin out Chrome, as the US government had asked that it be forced to. And he allowed deals for placement as the default search engine on the iPhone and other devices to continue so long as they aren't exclusive.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">One way of reading his ruling is that the current scaffolding of the web is so rickety that ruling in favor of a structural remedy like spinning out Chrome or banning all search payments might cause the whole thing to collapse. Mozilla, maker of the increasingly irrelevant Firefox browser, suggested it might go under if it couldn't take Google's money every year.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Whatever Google's lawyers meant in their filing, this does not sound like a healthy state of affairs.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;"><strong style="font-weight: 700;">II.</strong></p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">At first glance, <a href="https://www.platformer.news/r/9c9349ac?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">Atlassian's eye-popping acquisition of the Browser Company</a> last week for $610 million looks like a rebuttal to everything I have written above.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The six-year-old company, which this year discontinued development of its Arc product and recently pivoted into a more AI-forward browser named Dia, had a small fan base but nothing approaching true product-market fit. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">What it had instead was a founder in Josh Miller who relentlessly promoted the company's product development efforts through tweets, <a href="https://www.platformer.news/r/77c89812?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">blog posts</a>, newsletters, and <a href="https://www.platformer.news/r/a375b639?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">nearly 100 YouTube videos</a>. It was enough to (reportedly) get Perplexity and OpenAI, both working on AI browsers of their own, to kick the tires on an acquisition.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">That, plus the fact that Atlassian CEO Mike Cannon-Brookes was an Arc user, was enough produce an incredible payday for the Browser Company team. It would also seem to raise a question: if Atlassian is willing to spend so much money on what is essentially a beta version of a browser, doesn't that suggest that the open web has a bright future? </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">"By combining The Browser Company’s passion for building browsers people love with Atlassian’s deep expertise on how the world’s best teams operate, we have the opportunity to transform how work gets done in the AI era," Cannon-Brookes <a href="https://www.platformer.news/r/37fa5a30?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">wrote in a blog post</a>.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Read the rest of his post, though, and you'll see that the company's plans have little to do with "browsing" as the term has traditionally been defined. The next version of Dia will be "optimized for the SaaS apps where you spend your day," Cannon-Brookes writes, and "packed with AI skills." One demo in the blog post shows the browser extracting action items from an email; another just shows the amount of time remaining until your next meeting — but in the browser! </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Atlassian's vision for Dia is less a "browser" in the sense that we currently understand it and more as a layer or agent that sits on top of the applications that knowledge workers use for work, most of which are accessed via a browser. I believe that Perplexity and OpenAI have a similar vision for their own browsers — to create tools that use the web on your behalf, increasingly sparing you from ever having to browse it. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">As this iteration of the web takes root, far fewer sites will be supported by display ads. And unless <a href="https://www.platformer.news/r/e50e5709?m=51418983-c335-42dc-b433-9fac3bd4e54a" rel="noreferrer" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank">efforts like Cloudflare's pay-per-crawl initiative</a> gather momentum, it's hard to see how — whatever Google does or does not believe — the open web will not continue its rapid decline.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">There was a time when companies built new browsers to help you browse the web.
