Soon after, Grok — which remains rated for children 12 and older in the App Store — <a href="https://www.platformer.news/r/e43d0423?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>added a flirty, sexualized anime companion</u></a>.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">What Grok failed to do over the past few weeks was to hit No. 1 in the App Store — or to be featured by Apple as a recommendation. And so, in one of his frequent outbursts on X, Musk asserted that Grok must be the victim of a conspiracy. Surely Apple had colluded with OpenAI, with which it has a partnership to make ChatGPT available on its devices, to prevent Grok from being featured?</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“Apple is behaving in a manner that makes it impossible for any AI company besides OpenAI to reach #1 in the App Store, which is an unequivocal antitrust violation,” Musk wrote on X. “xAI will take immediate legal action.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Not all of Musk’s legal threats become actual lawsuits. It is seeking billions of dollars in damages.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">I have often felt sympathetic to developers who feel wronged by Apple on antitrust grounds. The fact that Apple can collect huge rents from Spotify while operating its own competing music service at a much lower cost has long struck me as unfair. Apple often does use its monopoly over iOS to take more than its fair share of developers’ revenues.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But Musk’s case against Apple (and OpenAI) has little to do with <em>that</em> sort of competition. Instead, it focuses on access to Apple’s promotional surfaces: its editorial recommendations, which often promote big revenue generators (that Apple takes a slice of); and its most-downloaded charts, which presumably are based on some empirical measures but remain relatively opaque.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It then argues that Grok cannot compete fairly with ChatGPT because of Apple’s deal with OpenAI, and argues that Grok should be available at the system level in Apple’s operating systems.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Until recently, right-wing businesses accepted the idea that other businesses had a right to express themselves. If Apple wanted to recommend Twitter but not Parler or Gab — or sign a deal with Google rather than Microsoft’s Bing — well, that was Apple’s business.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But during the first Trump Administration, conservatives became well practiced at lodging grievances when they perceived that a tech platform had disadvantaged them in any way. In 2018, <a href="https://www.platformer.news/r/68bec057?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>President Trump excoriated Twitter</u></a> over accusations that it had “shadow banned” the accounts of some Republican politicians because their names stopped auto-populating in search. (The explanation involved a bug, personalized search results, and a company effort to restrict the reach of accounts that had violated its rules.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">The same year, <a href="https://www.platformer.news/r/7025b39d?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>Trump blasted Google</u></a> after finding that searches about him mostly returned critical news reports. Rep. Devin Nunes, R-CA, <a href="https://www.platformer.news/r/20376ef7?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>sued Twitter in 2019</u></a> over allegations that it had “shadow banned” him and promoted defamatory tweets by accounts critical of him. (Two of them were famously named Devin Nunes’ Mom and Devin Nunes’ Cow.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Nunes <a href="https://www.platformer.news/r/30531727?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>lost</u></a> the case on Section 230 grounds: the law protects platforms from legal liability over what their users post.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">This sort of legal whinging has continued into Trump’s second term; last month we talked about the Missouri attorney general who <a href="https://www.platformer.news/r/716b7fbf?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>threatened to investigate OpenAI</u></a> because ChatGPT ranked Trump last on a list of recent presidents on antisemitism issues.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It’s a short jump from “it’s illegal to rank Trump last” to “it’s illegal not to feature Grok in the App Store.” And now here we are.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Apple didn’t respond to my request for comment today. Earlier this month, they <a href="https://www.platformer.news/r/285412f0?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>told Bloomberg</u></a> that the App Store “is designed to be fair and free of bias.” “We feature thousands of apps through charts, algorithmic recommendations and curated lists selected by experts using objective criteria,” they told the outlet.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">OpenAI, for its part, told me in a statement: “This latest filing is consistent with Mr Musk’s ongoing pattern of harassment.” (OpenAI has countersued Musk, alleging fraudulent business practices and a “yearslong campaign of harassment.” Earlier this month, <a href="https://www.platformer.news/r/ab292db4?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>a judge ruled that its suit can proceed</u></a>.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">How should we think about Musk’s claims? I asked Mark Lemley, a professor at Stanford Law School and expert in tech antitrust. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On the first claim — that Apple has unfairly disadvantaged Grok by not ranking it No. 1 in the App Store — Lemley said it’s unclear what the antitrust violation is supposed to be. This isn’t like the conflicts that Apple has had with Netflix, or Spotify, where those companies attempt to communicate with their own customers in their apps and are prevented from doing so by Apple. Indeed, the suit does not allege that Apple has interfered with Grok in the App Store at all. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“To the contrary, it says Grok and X are not only on the store, but are among the very top apps in their fields,” Lemley told me. “X's complaint seems to be that Apple's own subjective listing of ‘must-have apps’ doesn't rank them highly enough. But there is no antitrust right to have Apple go out of its way to recommend your app.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">Musk’s second claim is more interesting, if only because it echoes the government’s antitrust claim against Google: that by paying Apple for default placement in search results, Google has illegally maintained its monopoly. The government won that case, and a proposed remedy from the judge in the case is expected any day now.</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">But OpenAI’s deal with Apple is different for a few reasons. One, <a href="https://www.platformer.news/r/58b267bf?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>there is reportedly no money being exchanged between the companies</u></a>. (Apple’s search deal, on the other hand, represents a $20 billion annual windfall for the company.)</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">And two, the AI market is much less mature.  </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">“ChatGPT is not an entrenched, established monopoly, as Google is,” Lemley said. “And unlike search, there is nothing preventing people from running different AI systems on their iPhones. Apple had to choose one to run on Siri. While I can imagine Apple using a one-time choice screen, the work of integrating different AIs into Siri seems considerably greater than just linking to different search engines. And without an entrenched monopoly, I am doubtful a court would order such a remedy.”</p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">On the other hand, as NPR’s Bobby Allyn <a href="https://www.platformer.news/r/2efddd58?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>noted</u></a>: Musk continues to file suits in the Northern District of Texas, far from where OpenAI and Apple are located, and which has been <a href="https://www.platformer.news/r/f691b44e?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>very friendly to him</u></a>. </p><p style="margin: 0 0 1.5em 0; line-height: 1.6em; color: #15212A;">It does seem crazy that you might be able to sue your way to the top of the App Store. But then, it seemed crazy to <a href="https://www.platformer.news/r/36ac9634?m=51418983-c335-42dc-b433-9fac3bd4e54a" style="overflow-wrap: anywhere; color: #2047FF; text-decoration: underline;" target="_blank"><u>sue people into advertising with you</u></a>, too.
